I got my Pierce County Bar card today. Brad Moore and I are starting a trial in Tacoma in October and in order to get into the Pierce County Superior Court without going through their security line, I got a photographed PC bar card.
I went backpacking for one overnight this weekend in Foss Lakes. My friend and I hiked 7.5 miles and 3000 ft in elevation in the first day to Big Heart Lake. It was breathtaking and beautiful. While staring at the fast moving mist, I thought about my upcoming week.
Today, I called defense counsel’s office to try for the fifth time to request a copy of my client’s deposition transcript. They refused. I fumed. In cases of clear liability, I still don’t understand why my clients have to pay certain costs to litigate. I routinely get refusals from defense counsel about providing transcripts, medical records, etc.
Last month our Washington Supreme Court distinctly recognized that police officers owe a duty of reasonable care just like any other private individual when they interact with others. In other words, officers have a duty to act just like a similarly situated person (another police officer) would in their shoes.
